The Kentucky Division of Waste Management (DWM) is updating records for Conditionally Exempt Small Quantity Generators (CESQGs). Notices to registered CESQGs were sent June 22, 2017. The notice requires that registrants update Form DEP 7037 Kentucky Notification of Hazardous Waste Activity Form or submit Form 7086 Request to be Removed from Hazardous Waste Handler List with 45 days. I recommend sending the completed form certified return receipt requested for delivery no later than August 4th. Failure to respond will result in the company being removed from the active generator list and termination of the EPA ID Number. Forms can be accessed at http://waste.ky.gov/HWB/Pages/HWBforms.aspx or by following the quick links from the main DWM page. If you are asked for a user account and password when downloading, just click cancel and the form will open. Form 7037 Instructions are available here. Forms should be submitted to the Kentucky Department for Environmental Protection, Division of Waste Management, Hazardous Waste Branch, 300 Sower Blvd., Frankfort, KY 40601.
It is a great time to review your generator status, waste determinations, and update your contacts. The Federal RCRA regulations were updated last year, and the Kentucky DWM is working on a new set of rules as a result. Be on the lookout for a DRAFT set of revised Hazardous Waste Regulations from DWM to be published on or about August 1, 2017.
