Changes to Section 316(b) Need Close Scrutiny

For almost a year, EPA has been working on revisions to Section 316(b) of the Clean Water Act. This section is designed to protect in-stream life from dangers associated with cooling water intake. The final rule must be issued by July of 2012. The proposed rule currently on the table has been criticized by environmental groups as well as industry. The latest development is a detailed information request sent by Region I staff to facilities in Maine. With the short timeframe to issue a final rule, the general unhappiness with the current proposed rule, and the changes we could be seeing in short order, this development bears close scrutiny.
